Laurel Web Online Services, Inc.-Terms of Service
Use of Laurel Web's Services constitutes acceptance of these terms and conditions.

Acceptable uses of Laurel Web's services include, but are not limited to: transmission of any lawful personal communications, any use in support of lawful research, education, training, communication, publication, or recreation, and publication of personal materials in the interest of art, education or entertainment. Holders of commercial accounts may also engage in transmission of advertising or marketing materials to those who have requested such, transmission of any lawful business communications, and publication of marketing material for legitimate business purposes.
Laurel Web recognizes that many of our surfers are children or parents surfing with their children, and they come from all races and cultures around the world. For that reason, and for ethical and moral reasons, Laurel Web will not host pornographic sites, racially offensive sites, or ethnically offensive sites. Laurel Web reserves the right to monitor or check any condition it feels may harm its system. This includes but is not limited to: email, web server, and radius.

Users will not engage in any activity that unreasonably burdens Laurel Web's system resources. Laurel Web reserves the right to determine what is considered an unreasonable burden.

If you use another organization's networks or computing resources, you are subject to their permission and usage policies.

Payment Terms:
Each Customer is responsible for any and all fixed and accumulative charges for their account. The first month service fee (or other available billing period selected) is due upon account setup. Each month (or other billing period selected), on the date of the application, the account will be charged the monthly access and any other fees for the new month plus any accumulated charges for the past month. Unused hours do not accrue from one month to the next. Failure to use this account(s) does not relieve the user of payment obligations. Further, you are responsible for ALL charges associated with connecting to Laurel Web You agree that any telephone charges incurred are your responsibility. Depending upon your calling location, the nearest access number may not be a local phone call and you may be subject to long distance charges. You should check with your local phone company to determine whether any particular access number is a local call. If you access Laurel Web from certain access numbers, you may be assessed communication surcharges on your telephone bill. You are responsible for all activities and charges under your account(s), including any unauthorized charges to your account.

CREDIT CARD:
Credit Card customers agree to allow Laurel Web to bill such card on each successive billing date without obtaining the user's permission after the initial charge. Credit Card customers shall notify Laurel Web of any changes in Credit Card Number or expiration date. If the card is not honored for any reason, Laurel Web will attempt to notify the cardholder by using the telephone information given at sign-up and by E-mail. Laurel Web will call the cardholder, and if alternative billing has not been established within five (5) days, the account will be disabled.

CHECK:
If payment is by check or money order, payment due dates are indicated on your Email invoice. Dishonored checks are subject to a collection fee and your account may be suspended until the account is current. If payment is not received within five (5) days of the due date, service will be terminated until such time Laurel Web has received that payment. Your account must be paid by the 15th of each month, following receipt of your invoice to remain an active account. Laurel Web reserves the right to deactivate any account, that has not paid its current or past due monies within the allotted time above, without notice. There will be a $25.00 fee charged on all NSF or returned checks. Laurel Web also reserves the right to change its billing policy without notice. Any change in its billing policy will be posted on Laurel Web Payment Policy web page. Checks are only accepted for Annual Plans!

Client Rights:
The right to use Laurel Web's service is not transferable. Accounts are for your use only! User is responsible for the confidentiality of user's passwords. Loaning your account to others, connecting a system used by multiple persons, group use of user log-ins, and consuming more than one modem line are explicitly prohibited unless agreed upon in advance by Laurel Web If the user has multiple accounts, then the user is limited to one log-in session per system account at any time. Violation of this policy will be considered as theft of service and will be prosecuted under civil and criminal law.
Laurel Web's services should not be used to send unsolicited advertising or promotional materials to other network users. Electronic mail and appropriate Usenet newsgroups may be used in the conduct of legitimate business. We do not allow users to run Mail lists, List servers or any form of auto-responder from a users account. Processes that run or are activated while the user is not logged in are also NOT ALLOWED. Continued harassment of other individuals on the Internet after being asked to stop by those individuals and Laurel Web will not be tolerated. When Laurel Web becomes aware of possible violations, Laurel Web will initiate an investigation. At the same time, in order to prevent further possible unauthorized activity, Laurel Web may suspend access to services to the individual account in question. Confirmation of violations may result in cancellation of the individual account and/or criminal prosecution. The account suspension may be rescinded at the discretion of Laurel Web following payment of a reconnection charge. Use of this account to violate the security of any computer network, crack passwords or security encryption codes, transfer or store illegal material including that deemed threatening or obscene, or engaging in any kind of illegal activity is expressly prohibited. Client will abide by all the rules, regulations and policies of those networks and computer systems accessed via this account. If the Client is unsure of those policies, it is the Client's responsibility to ascertain said policies.

These terms and conditions are subject to change without notice. A current copy will be available on-line on Laurel Web's home page. Continued usage of your account after a new policy has gone into effect constitutes acceptance of that policy. We encourage you to regularly check the policy statement for any changes.

Cancellation and Termination of Dial-up Contract:
Laurel Web has the right to terminate service for any unpaid subscriptions. Accounts in default are subject to an interest charge of 1.0% per month (12% per annum) on the outstanding balance. Termination of service shall not relieve the user from the obligation to satisfy outstanding invoices. In the event Laurel Web utilizes an attorney to collect such sums, the user shall be responsible for the payment of all of Laurel Web's attorneys' fees and costs, allowable by Pennsylvania State law, in the collection of these sums. Any litigation concerning the user's relationship with Laurel Web shall be in Westmoreland county, in the state of Pennsylvania.

Laurel Web reserves the right to cancel service for any reason without prior notice. In case of cancellation, unused fees may be returned to the user on a monthly basis.
Termination or Suspension does not release liability for charges due. Laurel Web may delete all data, files or other information that is stored in subscriber's account of hosted Web Site upon termination. The client must notify Laurel Web to cancel service. Fees for any setup or software are not refundable, unless the customer is unsuccessful in using the account and notifies Laurel Web within five (5) days of establishing said service.

Please do not call or leave messages! Only the above mentioned forms of cancellation will be honored NO EXCEPTIONS. There is a $75.00 early termination fee for Annual Subscriptions.

By use of any of the pages and their links on Laurel Web's site, users agree that all information is provided "AS IS" and that Laurel Web's link to a site does not, in any way, represent or imply an approval of or a determination of the quality of that product or service. The links provided herein are maintained by their respective organizations, and they are solely responsible for their content.

Indemnity:
The subscriber agrees to indemnify and hold harmless Laurel Web, its directors, officers, shareholders, agents, employees and its other subscribers from any and all claims, liabilities, damages, or expenses, including attorney fees, arising out of or resulting from any and all use of subscriber's account or the subscriber's Web Site whether or not authorized.

Non-Transferability:
Client's account and right to use Laurel Web's services and system is not transferable without Laurel Web's consent. If applicable, client agrees to protect their password and account and to keep them secure from unauthorized users and use.

Confidentiality:
Laurel Web treats E-mail messages as private. Exceptions are those permitted by law, included under the Electronic Communications Privacy Act of 1986 (the "ECPA"). The ECPA permits Laurel Web's limited ability to intercept and/or disclose electronic messages, including, for example (I) as necessary to operate the system or protect Laurel Web's rights or property, (ii) upon legal demand (court orders, warrants, subpoenas) or (iii) where Laurel Web receives information inadvertently which appears to pertain to the commission of a crime. Users should be aware that electronic messages may be intercepted lawfully or unlawfully outside of Laurel Web's system. In addition, although Laurel Web has implemented certain security measures, Laurel Web cannot guaranty that its system or stored data of a subscriber will be free from unauthorized intrusion or otherwise guaranty the privacy of information of any user.

Interpretation:
These Terms of Service supersede all other written and oral communications or agreements with regard to the subject matter. A waiver or modification of these Terms of Service shall only be effective if in a writing signed by an authorized officer of Laurel Web These Terms of Service shall be governed by and interpreted in accordance with the laws of the State of Pennsylvania without regard to choice of law principles. If any provision of these terms and conditions is found to be unenforceable or invalid, the remaining provisions shall be enforceable and valid to the greatest extent permitted by law.
Members and visitors to the Laurel Web's online web site agree to comply with our Policies and Terms and Conditions.
Laurel Web Online Services is not responsible for any long distance charges associated with
your dialing into a dial-up number the is not local to your area. It is your responsibility to make sure you are calling a local number.
